Zehn Creations Corp. (Operating as “Zehn”)

Section 1 – Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your province/state/territory of residence, and you have given consent to allow any minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services (including browsing our store or purchasing products), you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 – Our Products

We sell cosmetic hair care products, including Zehn Hair Serum (a premium botanical/plant oil blend). We make reasonable efforts to accurately display our products, but colors and appearance may vary by device and settings.

Product descriptions, ingredients, packaging, and availability may change from time to time without notice. We reserve the right to discontinue any product at any time and to limit quantities sold to any person, household, geographic region, or jurisdiction on a case-by-case basis.

Section 3 – Orders

When you place an order, you are making an offer to purchase. Zehn Creations Corp. reserves the right to accept or decline any order for any reason at its discretion. Your order is not accepted until we confirm acceptance and successfully process payment.

Fraud prevention: We reserve the right to cancel or hold any order that is flagged by our fraud detection systems or payment processor for verification.

Please review your order carefully before submitting. After an order is accepted, we may be unable to accommodate cancellation or address-change requests, especially once fulfillment has started. If we do not accept, change, or cancel an order, we will attempt to notify you using the contact details provided at checkout.

Purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent that purchases are for personal or household use unless expressly authorized in writing by Zehn Creations Corp. Commercial resale, redistribution, or export without our prior written consent is prohibited.

Section 4 – Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be shown in your order confirmation. Unless stated otherwise, posted prices do not include shipping, handling, customs, duties, or import charges.

We may offer promotions governed by separate terms. If there is a conflict between promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase and account information and to promptly update it as needed. You represent and warrant that the payment method you provide is authorized and that you will pay all charges incurred at the posted prices, including applicable shipping and taxes.

Section 5 – Shipping and Delivery

Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs processing, weather, or other events outside our control.

Once we transfer products to the carrier, title and risk of loss pass to you to the fullest extent permitted by applicable law (this does not limit any mandatory consumer rights that cannot be waived).

Section 6 – Intellectual Property

Our Services and their contents (including trademarks, branding, text, images, graphics, product descriptions, reviews, video, and audio, and the design, selection, and arrangement thereof) are owned by Zehn Creations Corp. or its licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent, except as permitted by law.

Nothing in these Terms grants you any license or rights under any patent, trademark, copyright, or other intellectual property rights of Zehn Creations Corp., Shopify, or any third party, except as expressly stated. All rights not expressly granted are reserved.

“Zehn”, “Zehn Creations”, “Zehn Hair Serum”, and related names, logos, product and service names, designs, and slogans are trademarks of Zehn Creations Corp. You must not use such marks without prior written permission. Shopify’s name, logo, and related marks are trademarks of Shopify. All other names and marks belong to their respective owners.

Section 7 – Optional Tools

We may provide access to third-party tools as part of the Services. We do not monitor or control them. You acknowledge and agree that access is provided “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement. We are not liable for your use of optional third-party tools.

Future features or tools may be added and will also be part of the Services and subject to these Terms.

Section 8 – Third-Party Links

The Services may include third-party content or links. We are not responsible for examining or evaluating their content, accuracy, or practices. If you access third-party sites, you do so at your own risk. Complaints or questions about third-party products/services should be directed to the third party.

Section 9 – Relationship with Shopify

Zehn Creations Corp. is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Zehn Creations Corp. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Zehn Creations Corp., including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Zehn Creations Corp.

Section 10 – Privacy Policy

All personal information collected through the Services is subject to our Privacy Policy. Certain information may also be subject to Shopify’s Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes information about your access and use of the Services to provide and improve them. Your information may be transmitted to and processed in other countries in order to provide services to you. Please review our Privacy Policy for details.

Section 11 – Feedback

If you submit ideas, suggestions, feedback, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use.

You represent and warrant that you own or have all necessary rights to the Feedback and that it complies with these Terms and applicable laws. We may remove Feedback at our discretion.

Section 12 – Errors, Inaccuracies and Omissions

Occasionally there may be information that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping, transit times, or availability. We reserve the right to correct these and to cancel orders if information is inaccurate at any time without prior notice (including after you submit an order).

Section 13 – Prohibited Uses

You may use the Services only for lawful purposes. You may not use the Services to violate laws, infringe intellectual property, harass or harm others, transmit malware, scrape data, spam, impersonate others, or otherwise interfere with the security or operation of the Services. We may suspend or terminate access if we believe you have violated these Terms.

Section 14 – Termination

We may terminate this agreement or your access to the Services (or any part thereof) at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Provisions that by their nature should survive termination will survive, including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, and Governing Law.

Section 15 – Disclaimer of Warranties

Information on the Services is provided for general information only. We do not warrant its accuracy, completeness, or usefulness. Any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY ZEHN CREATIONS CORP., THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Section 16 – Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZEHN CREATIONS CORP., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY EVENT, TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Section 17 – Indemnification

You agree to indemnify, defend, and hold harmless Zehn Creations Corp., Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your use of the Services.

Section 18 – Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

Section 19 – Waiver; Entire Agreement

Our failure to enforce any right or provision is not a waiver. These Terms and any policies posted on the site constitute the entire agreement between you and us regarding your use of the Services and supersede prior agreements or communications.

Section 20 – Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms without notice where permitted by law.

Section 21 – Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any dispute will be brought in the courts located in Ontario, Canada, unless applicable consumer protection laws in your jurisdiction require otherwise.
